Murder

 

 

Massachusetts general law Chapter 265, Section 1 governs murder.  The law states as follows:

 

 

Section 1. "Murder committed with deliberately premeditated malice aforethought, or with extreme atrocity or cruelty, or in the commission or attempted commission of a crime punishable with death or imprisonment for life, is murder in the first degree. Murder which does not appear to be in the first degree is murder in the second degree..."

Penalty

 

A conviction for first degree murder requires a life sentence without the possibliity of parol.  Second degree murder also is life imprisonment with the opportunity for parol.  Often times murder charges through negotiations can be reduced from murder I to murder II, or perhaps murder II to manslaughter.  Manslaughter carries a sentence of not more then 20 years.
